Mediation

We guide clients through mediation, whether as part of ongoing litigation or prior to it, when parties look for an amicable settlement before proceeding.
Slotine has been a signatory of the Department of Justice pledge “Mediate First” since 2020. Maëva Slotine is an accredited mediator with HKMAAL and is referenced as a mediator by HKMAAL, the Labour Tribunal and the Small Claim Tribunal in Hong Kong.
WHAT
Mediation is negotiation assisted by a third party. This means that:
  • The parties voluntarily work together to reach an agreement with the help of a third party, the mediator / mediatrix.
  • The mediator / mediatrix is there to assist the parties, helping them to communicate better and work out a solution together.
  • The mediator / mediatrix does not provide the solution, but rather stimulates the parties’ creativity to come up with the best possible solution.
  • The parties are usually assisted by their counsel.
  • Mediation offers a number of advantages over traditional dispute resolution methods (litigation and arbitration): it is faster, more constructive, more creative and less costly. It is a cooperative process, based on re-establishing trust through communication. It takes a holistic view of the conflict, taking into account parameters such as the emotions, needs, values and interests of the parties that are not taken into account by these procedures, and broadens the scope for solutions. Mediation limits the escalation of violence associated with the judicialization of the dispute, and the solution chosen by the parties poses no implementation problems.
